These conditions of sale are intended to define the contractual relationship between Vigie (Virginie NGUYEN QUANG) and the buyer and the conditions applicable to all purchases made through the site “art-vigienguyen.fr”, whether the buyer is a professional or a private individual.

Virginie NGUYEN QUANG, is a self-employed entrepreneur, domiciled at 18 Rue de l’Ile de Sein, 56 600 LANESTER – FRANCE, currently in the process of registering. Until her registration is obtained, no payment, even a deposit, will be requested, and no order will be validated. During this waiting period, you can still reserve originals or limited edition prints. You will be informed as soon as the order can be placed.

The acquisition of an original creation by Virginie NGUYEN QUANG, or a limited edition print, via this site, or directly, implies unreserved acceptance by the buyer of these conditions of sale.

These conditions of sale shall prevail over any other general or special conditions not expressly approved by Virginie NGUYEN QUANG.

Virginie NGUYEN QUANG reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

The characteristics of the works and reproductions offered for sale are presented on the page dedicated to each work on this site, accessible from the gallery.

Each original work and each reproduction is certified and numbered with a certificate issued by Virginie NGUYEN QUANG.

The photographs of the works presented on this site and in the catalog are as accurate as possible, but cannot guarantee a perfect similarity with the product offered, particularly with regard to colors. All texts and images presented on the “art-vigienguyen.fr” site are reserved, for the whole world, under copyright and intellectual property rights, and their reproduction, even partial, is strictly forbidden. Copyrights are not transferred with the purchase of a work, and reproduction, even partial, is therefore forbidden, even to the purchaser of the work, without the written authorization of Virginie NGUYEN QUANG or her assigns.

1. Purchase

1 – The prices of the works are indicated in Euros, all taxes included, excluding shipping costs.

All orders are payable in Euros only, at the time of ordering, by one of the methods proposed.

2 – As the artist’s reputation increases, prices may rise at any time. The price charged will be the price indicated when you place your order.

Anyone wishing to purchase an artwork must :

Send an email via the contact form or directly via the address, contact@art-vigienguyen.fr, giving your surname, first name, email address, telephone number, delivery address, invoicing address, the name of the work(s) you wish to order, and/or the quantity you wish to order if it is a limited edition reproduction.  Declared to have read and accepted the present General Terms and Conditions of Sale.

He will then receive confirmation of his order by email, with an order number and details of the order, including the total price including VAT and an estimate of delivery costs. The information required to pay for the order.

Payment must be made in accordance with the conditions laid down.

Confirmation of the order by payment implies acceptance of these terms and conditions of sale, acknowledgement of having read them, and waiver of the right to invoke the customer’s own terms and conditions of purchase or any other terms and conditions.

The customer will be informed when payment has been received, which validates the order. He will then be informed of the dispatch of his order, and will be able to track it, with a specific number.

All the data supplied and the recorded confirmation will constitute proof of the transaction. Confirmation will constitute signature and acceptance of the operations carried out.

2. Validation of your order

A confirmation letter will inform you of the acceptance of your order, and an approximate date of receipt. You will be kept informed at every stage.

The order will only be validated once full payment has been received, including delivery costs.

When validating your order, you declare that you have read and accepted these terms and conditions of sale.

3. Withdrawal and refund

You have the right to withdraw from this contract, without giving any reason, within a legal period of 14 days. This period begins on the day following receipt of full payment for the order.

To exercise your right of withdrawal, you must notify us of your decision by means of an unambiguous statement, within the legal time limit, by email to the following address: contact@art-vigienguyen.fr

You will be reimbursed for all costs incurred (order price and delivery costs) within 14 days of receipt of your withdrawal email.

We will proceed with the reimbursement using the same means of payment that you used for the initial transaction, with the exception of payment by cheque, in which case a transfer will be made to the purchaser once we have received his/her bank details.

4. Shipping

Delivery will be made to the delivery address indicated, within 15 to 30 days of receipt of payment, if the work is not being exhibited. No shipment will be made before the legal withdrawal period, in order to avoid incurring delivery charges.

As original works are unique, they can sometimes be part of an exhibition. If the work is in the process of being exhibited, the delivery date will be discussed with the buyer prior to payment, in order to reach a mutually acceptable agreement.

5. Delivery cost

Delivery costs will be given to you at the end of your order process. Delivery charges include the cost of insurance on the value of the goods.

It is your responsibility to check the condition of the parcels on receipt and to indicate on the receipt the words « under reserve » in order to benefit from the guarantees contracted in the event of deterioration of the works.

6. Delivery planning

You will be informed by e-mail of the progress of your order, and of the delivery.

7. Taxes

For deliveries outside mainland France, you will have to pay any taxes that may be required. You must check with the authorities in your country.

The purchaser undertakes to check the possibility of importing the products ordered into the territory of the country of delivery.

8. Payment methods

• Wire transfer: Virginie NGUYEN QUANG’s bank details will be sent to you upon confirmation of your order.

• Cheque: made payable to Virginie NGUYEN QUANG, with the order number on the back, and sent to Virginie NGUYEN QUANG – 18 Rue de l’Ile de Sein – 56600 LANESTER – France

9. Return policy

You have 14 days from receipt of the artwork to change your mind. You are responsible for the return of the artwork, under the same shipping conditions as the original shipment (packaging, protection, insurance).

The cost of the artwork will be reimbursed within 15 working days of receipt, provided there has been no deterioration.

10. Guarantee

All paintings and drawings are unique pieces, signed by the artist. Limited edition prints, signed and numbered, are also available.

Each original work and each reproduction is also stamped with the artist’s logo on the reverse, and provided with a numbered holographic seal for enhanced authentication.

Each original work and each reproduction is sold with a certificate of authenticity.

The acquisition of a work of art does not give the purchaser any right of representation, distribution or reproduction. Only the artist retains the right to his or her creation. Any use of the artwork’s visuals must be authorized by the artist or his assigns.

This contract is governed by French law. Any dispute shall be submitted to the exclusive jurisdiction of the Paris courts.

11. Privacy policy

To place an order, you will be asked to provide certain personal information, which will be processed by computer in order to properly process your order. By confirming your order you authorize Virginie NGUYEN QUANG to communicate this information for the sole purpose of processing your orders. They are stored and protected at the home of Virginie NGUYEN QUANG. Your data will not be sold or exchanged with a third party. It may, however, be used to inform you of events or new works for sale on this site.

In accordance with the French Data Protection Act of January 6, 1978, you may request changes to this information or ask to be removed from Virginie NGUYEN QUANG’s database by contacting her by e-mail at the following address: contact@art-vigienguyen.fr.
